PRIVACY POLICY

1.     Parties:

Practitioner: Morgan Willoughby, trading as By Morgan ABN 67235714322, referred to herein as ‘By Morgan’, ‘Morgan Willoughby’ or ‘practitioner’ interchangeably.

Client: ‘Client’ refers to the booking holder undertaking services provided by the Practitioner above-mentioned.

2. Purpose of Sessions

All kinesiology, psychic insights and spiritual coaching sessions conducted by Morgan Willoughby are designed to offer individuals insight and guidance into their well-being for their own decisions or actions, and to facilitate relaxation and energetic rebalance.

3.     Services:

The services provided by Morgan Willoughby are varied and diverse including, but not limited to, Kinesiology, energy rebalancing, spiritual coaching and intuitive guidance, muscle-testing, sound frequency work, food insights, environmental factors, breathwork and other spiritual and relaxation techniques. Collectively, Morgan’s services are defined herein as ‘Energetics’  for simplicity.

4. Dual Confidentiality

All client information, personal data and discussions are held in strict confidence and will not be disclosed without your explicit consent, except as required by law.

All business or personal information disclosed by Morgan Willoughby is confidential, to be shared or distributed only with written approval from Morgan Willoughby or authorised personnel.

5. Fit for Energetics Work

Your participation in Energetics is entirely voluntary, and you participate on the basis that you are of sound mind to make informed decisions for yourself.

You acknowledge that if any mental health or medical concerns are present in your life, that you have consulted with your relevant practitioner/s before engaging in this Energetics session. You acknowledge that it is not a requirement to divulge any existing conditions in order to participate in Energetics work with Morgan, and all responsibility lies entirely with you.

6. Consent

You understand that during an Energetics session, Morgan Willoughby may need to physically touch you for muscle testing or to perform particular processes. It is your responsibility to raise any concerns with Morgan before commencing Energetics work, to ensure a respectful and safe process for yourself.

By way of agreeing to these terms you provide consent on all levels of consciousness for Morgan Willoughby to receive intuitive insights and to activate Energetics within you, for your highest good.

7. Commitment to Progress

Achieving desired outcomes requires active participation. Clients are expected to:

Attend sessions regularly as advised.

Follow instructions and advice provided during sessions.

Engage in recommended activities outside of sessions, including but not limited to healthy eating, rest, and exercise guidelines.

8. Session Details

Initial Session: The first session includes a comprehensive assessment and typically lasts between 1.5 to 2 hours.

Follow-up Sessions: Subsequent sessions are approximately 1.5 hours in duration unless otherwise agreed.

Sessions for Oracle or Spirit Guide readings are 45minute duration unless otherwise agreed

9. Preparation for Sessions

To maximize the benefits of your session:

Attire: Wear loose-fitting clothing suitable for stretching and full range of motion.

Pre-Session Tasks: Complete any assigned tasks before your appointment. Sessions may be rescheduled or cancelled if tasks are incomplete, and standard cancellation policies will apply.

10. Payment and Pricing

Payment is automated via the relevant online booking service. If alternative payment arrangements are needed, they must be arranged separately by contacting By Morgan directly.

Accepted payment methods include cash and credit card.

If you have private health insurance that covers kinesiology, you may be eligible for rebates. Please confirm this directly with your provider.

A schedule of fees and services will be provided for coaching packages and becomes a binding appendix to this agreement.

11. Cancellation and Late Policy

Cancellations: Please provide at least 24 hours' notice if you need to cancel or reschedule a session. Late cancellations or reschedules will incur the full session fee.

Rescheduling: Reschedules will be arranged at a time that is mutually suitable for both the client and practitioner. Rescheduling more than three times will be deemed a full cancellation and full fee will be incurred. Note: A declined meeting invitation is not adequate notice and Morgan Willoughby must be advised in writing by email or text for any rescheduling.  

Lateness: If you arrive late, the session will still conclude at the scheduled time. If the practitioner is running late, efforts will be made to extend your session accordingly.

12. Health and Well-being

Do not attend sessions if you are sick, injured, under the influence of alcohol, drugs, or in a physically unwell state that could hinder the session.

13. Right of Refusal of Service:

By Morgan may refuse any client, for any reason and will provide a full refund if this occurs. Morgan Willoughby is not required to provide a reason.

The practitioner reserves the right to cancel a session if they deem it unsafe to proceed, in line with the cancellation policy.

13. Refunds

A full refund will be provided for any unused pre-paid sessions or for sessions cancelled with at least 24 hours' notice. Refunds will be issued within 7 days of written notice of the cancellation or by written agreement between both parties.

No refunds apply for sessions undertaken and completed.

14. Complaints Handling:

Should there be any complaints or concerns with the standard of service, you commit to raising the issues directly with Morgan Willoughby before sharing on social media channels to give Morgan the ability to respond directly to you in good faith.

15. Intellectual Property

All materials provided during sessions or through By Morgan's online platforms remain the intellectual property of By Morgan. Reproduction or distribution without prior written consent is prohibited.

16. Jurisdiction

This agreement is subject to the laws of Victoria, Australia. Any disputes will be resolved under the jurisdiction of the courts of Victoria, Australia.

17. Data Handling and Privacy Policy:  

17.1 Cookies

If you visit the login page, a temporary cookie will be created to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, several cookies will be created to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

17.2 Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

 

17.3 Data sharing

If you request a password reset, your IP address will be included in the reset email.

 

17.4 Data retention

For users that register on this website (if any), or purchase from the store the personal information provided will be retained in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

17.5 Rights over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

17.6 Where By Morgan sends your data

Visitor comments (if activated) may be checked through an automated spam detection service.

If you register on this site for newsletter emails your information will be synchronised with a private CRM system managed by By Morgan to activate future emails at your request. You can unsubscribe at any time.

 

17.7 Sale of your data

Your data will never be sold for any purpose to anyone, at any time now or in the future.

18. Liability and General Agreement

By engaging in services with By Morgan, you acknowledge that you have read, understood, and agree to these terms and conditions.

These sessions do not constitute medical, psychological, legal, financial, business, professional or relationship advice, diagnosis or treatment. By participating in a session and/or future sessions, you acknowledge that Morgan Willoughby does not diagnose illnesses or guarantee specific outcomes.

Morgan Willoughby is not liable for any claims, damages, or legal actions arising from the participation in Energetics sessions. You acknowledge that all sessions are undertaken at your own risk and that no guarantees of specific outcomes are provided. You accept full responsibility for your participation and any outcomes resulting from sessions.

This agreement constitutes the entire understanding between the parties and supersedes all prior agreements, representations, or communications, whether written or oral, related to its subject matter.

If any provision of this agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect, interpreted in line with the overarching intention of this document.
